Who can challenge a Will in South Australia?

In South Australia, the people eligible to contest a Will are set out in section 6 of the Inheritance (Family Provision) Act. They are spouses and domestic partners of the deceased (including ex spouses), children and grandchildren of the deceased, step children in certain circumstances and parents and siblings in some other, limited circumstances.

For parents and siblings to challenge a Will they need to show that they cared for or contributed to the maintenance of the deceased person during the deceased person’s lifetime. This is not a low threshold to prove so it is important to ensure that you get good advice early on.
